The Texas Supreme Court on Friday said the execution of a man convicted of murder in the 2002 death of his 2-year-old daughter could move forward, even as a state house committee seeks to subpoena the man for his testimony and its bipartisan members fight to spare his life.

The state’s highest civil court ruled that legislators can’t use subpoenas to block death row inmates’ executions, but suggested there’s still time for Roberson to testify before a Texas House panel.

It is the latest twist in the political saga surrounding the Roberson case, which drew national attention and sparked fresh rifts within the Republican party.

The Texas Supreme Court on Friday said the execution of Robert Roberson, which would be the first over a death from shaken baby syndrome, can move forward after halting it last month.

The unanimous decision frees the state to reset Robert Roberson's execution date but suggests lawmakers may still be able to hear his testimony.

Both Republican and Democratic lawmakers issued a subpoena last month, calling death-row inmate Robert Roberson to appear in court at the Texas Capitol after what was supposed to be his execution date. Roberson was scheduled to die by lethal injection on Oct. 17.

The Texas Supreme Court denied a petition from the Texas House of Representatives on Friday and ruled that a committee subpoena can’t block a scheduled execution like Robert Roberson’s was on Oct. 17.

Roberson was scheduled for execution last month over the death of his 2-year-old daughter Nikki in 2002. Prosecutors argued Roberson violently shook Nikki, but the scientific validity of shaken baby syndrome has been called into question since then.

Roberson was convicted in the 2002 killing of his 2-year-old daughter but has long proclaimed his innocence. His lawyers as well as a bipartisan group of Texas lawmakers, medical experts and others have argued his conviction was based on faulty scientific evidence.
